Information on achievements of
Customs Service of the
Kyrgyz
Republic in the framework
of the Committee on Customs Cooperation (CCC).
Participation of Customs Service of
the Kyrgyz
Republic in the activity of the CCC, starting
in August, 2002, enabled it to solve a range of issues, directly connected with
regional trade facilitation. Among seven priority tasks, stated by the Common
Action Plan (CAP), on the way of
successful realization are the following:
«Development of joint customs control and infrastructure».
Among 3
aspects of the given issue, that include (1) development of the infrastructure,
(2) legal base for implementation of the joint control and (3) determination of
the optimal border crossing point for the implementation, for nowadays the two
are close to settlement.
During the 2nd CCC Meeting (Tashkent) a proposal of Kyrgyz and Kazakh parties is
approved, and a part of border on the crossing point «Akjol»-«Korday» between
Kyrgyzstan and Kazakhstan is determined as an area
for pilot testing.
Work on
implementation of the joint processing is based on before achieved bilateral
agreements in the framework of the Agreement between the Government of the
Republic of Kazakhstan and the Government of the Kyrgyz Republic on border crossing on the route
Almaty-Bishkek dated
15.11.1999.
Last
year an experiment on joint processing with attraction of all controlling bodies
of two states was conducted on the border crossing point Akjol-Korday.
Then,
Customs Services of the Republic of
Kazakhstan
and
the Kyrgyz Republic drafted Agreement
between the Government of
the Kyrgyz Republic and the Republic of Kazakhstan on joint control on the
kazah-kyrgyz
state border. Discussion of the draft Agreement was conducted with attraction of
related ministries and agencies of each of the Parties, that exercise control on
the border – Border Guard, Ministry of transport, agriculture,
helth.
Situation
for nowadays – the draft Agreement between the Government of
the Kyrgyz Republic and the Republic of Kazakhstan on joint control on the kazah-kyrgyz
state border is approved by the Decree of the Government of
the Kyrgyz
Republic
№57-р dated 31, January, 2005, and is ready for signing. On the base of the
available information, the approval of the draft Agreement by the Government
of the Republic of Kazakhstan is on a final stage.
«Development of the simplified
transit system».
For the first time the issue of simplification of transit is discussed in
detail during the workshop, conducted in Issyk-Kul (4-8, August, 2003), during
which CCC Secretariat has prepared an exhaustive working paper «Strategy and
Action Plan on Development of the Transit System», and two-aspect approach is
suggested for solution of the issue:

perfection of the already existing transit
systems: System of the International Road Transportation (TIR),as a basic
transit system, existing in the region.
·
development and acceptance in the framework of
the CCC an agreement on regional transit system.
Two transit systems would supplement
each other creating a favorable conditions for the trade development in the
region and interregional trade.
First practical result in the CCC
work on this issue is a signing on 26, March, 2004, in Bishkek of the Agreement
between the Government of the Kyrgyz Republic and the Government of the Republic
of Kazakhstan on transit transportation of goods by road transport through the
territory of the Republic of Kazakhstan, that came into force on 11, May,
2005.
The second result – is a signing on
22, July, 2005 of the Agreement between the Government of the Kyrgyz Republic and the Government of the Republic of Tajikistan on transit transportation of
goods by road transport, that for nowadays is sent for
ratification.
At the heart of this agreements
there is a mechanism, when customs service stands as guarantor, that financial
obligations in the case of non delivery of goods will be carried out before
customs service of the transit country. Our experience of a practical
application with kazah Party and of a practical application in a nearest future
with tadjik Party will serve as a base for development of a framework regional
agreement on transit.
«Modernization and reformation of the Customs Service of
Kyrgyzstan».
Taking into consideration that improvement of the investment climate and
economic situation in the republic is impossible without radical improvement of
the work of the customs service, in 2000 a systematic work on its
reformation and modernization has started. Also, globalization of trade and
acute jump in development of information technologies predetermined a new
direction in development of the Customs Service of the Kyrgyz Republic – the necessity to atomize a work
of the Customs Service.
In this connection, as a result of conducted two-year work with ADB,
kyrgyz Customs received the Loan in a sum equivalent to USD 7,5 million, aimed for two
targets:
- development and
implementation of the Unified Automated Information System;
- development of the border crossing
point infrastructure.
Also, we would like to mark several important
results, achieved in the framework of the CCC
activities.
One of the effective methods of
ensuring of the unification of customs legislation (that is a first point of the
CCC CAP) on the world level is a revised International Convention on
Simplification and Harmonization of Customs Procedures (Kyoto Convention), on
study of which at the beginning of the CCC activities a range of workshops were
conducted.
So, in the aim of realization of the first task
of the CAP, a new addition of
the Customs Code of the Kyrgyz Republic (CC) is developed and signed on
12, July, 2004 by the President of the Kyrgyz Republic,
and came into force on January,
2005. The new addition of the CC complies with the basic principles of
the revised Kyoto Convention and with the provisions of the WTO.
The new addition of the CC allows
considerably perfect a legal base of the customs bodies activity. For business
it ensures a stability and predictability of customs rules, uniform practice of
their application on the territory of Kyrgyzstan. On the base of the new
addition of the CC an economical methods of managements are predominate. In the new Customs Code the clear norms regulating all possible procedures are
included, i.e. maximum possible direct regulation of the legal relationship on
customs matters by the Code itself
is provided.
Data consolidation/information exchange and
development of information-communication technologies in customs
matters.
As a successfully implemented
activity on this issue we may consider a signing of the Protocol between the
General Customs Administration of the Peoples Republic of China and the Committee for Revenue under the
Ministry of Finance of the Kyrgyz Republic on cooperation in the field of
information exchange on the statistic of external trade in September, 2004.
Development of the regional customs
cooperation.
It is necessary to note that, in the aim of development of the regional
customs cooperation KGZ signed:
1.
Agreement
between the Government of the Kyrgyz Republic and the Government of Mongolia on
cooperation and mutual assistance in customs matters (Bishkek, 1, March, 2004).
2.
Agreement
between the Committee for Revenue under the Ministry of Finance of the
Kyrgyz Republic and the State Customs Committee of the
Azerbaijan Republic on cooperation and mutual assistance in
customs matters (Baku, 3, December, 2004).
At
the end we’d like to note that an assistance of the ADB provides a grate
facilitation to Customs Service of Kyrgyzstan, with the help of which Kyrgyz
Customs is going to finish automation, perfect and simplify customs procedures,
make a work of the Customs Service transparent and effective, create customs
infrastructure, which comply with its modern models, and also rise a level of
qualification of customs officials.
