Chapter 56. The provision of information
and consultations in the area of customs matter
Article 379. Obtaining Information on the Reasons for a Decision
Made, Action or Omission Committed
The person
with respect to which a customs body or its official made a decision or committed
an action, as well as the person, with respect to which no decision was made,
or an action to be committed was not committed within the established period
of time, shall be entitled to file an inquiry with the customs body asking for
the reasons and grounds for a decision made or an action committed or the reasons
and grounds for failure to make a decision or failure to commit an action, within
a two month period from the date of making the decision, commitment of the action
or expiration of the period of their adoption or commitment if that affects
the rights and legal interests of such person directly and individually.
The inquiry shall be immediately
considered by the customs body. If a written inquiry is filed the response shall
be made in writing.
Article 380. Information on Legal Acts in the Area of the
Customs Matter
The authorized
state body and other customs bodies shall provide all interested persons with
free access, including with use of information technology, to the information
on current normative legal acts in the area of the customs matter.
Customs bodies
shall provide access of interested persons to the information on amendments
to normative legal acts in the area of the customs matter, which have not come
into effect, including with use of information technology, except for cases
when a preliminary notification of the amendments in legal acts is not admissible.
Article 381. Consultancy on Customs Issues and Other Questions
within the Competence of Customs Bodies
1.
The customs bodies shall consult on customs issues and other questions within
the competence of these bodies in accordance with the procedure established
by legislation of the Kyrgyz Republic.
Information on customs issues raised by an interested person
shall be provided within the possible shortest period of time.
2.
The customs bodies shall provide consultations either verbally or in writing
free of charge.
3.
The information provided to interested persons during a consultation shall not
be deemed a ground for the making of a decision or action by customs bodies
in the course of customs procedures with respect to goods and means of transport.
Article 382. Liability for Unreliable Information
1. The customs
bodies shall bear liability stipulated by legislation of the Kyrgyz Republic for reliability of the information
provided to interested persons in compliance with provisions of this Chapter.
2. The customs bodies shall not
be liable for losses incurred as a result of misinterpretation of the texts
of the legal act, published without their knowledge and control, neither for
losses caused by incompetent consultations provided by persons having no authority
for that. |
