Chapter 51. Customs bodies
Article 361. Status of Customs Bodies.
Customs bodies shall have a status of law enforcement bodies.
No state
bodies, except for higher bodies of legislative and executive power of the Kyrgyz
Republic, shall be entitled to make decisions touching
upon competence of customs bodies, to carry out without appropriate permission
or change their functions, to delegate additional tasks or otherwise interfere
in the activity of these bodies, which complies with legislation of the Kyrgyz
Republic.
Article 362. Flag and Emblem of Customs Bodies
Customs bodies shall have a flag
and emblem. It shall be allowed to put the emblem on motor means of transport
of customs bodies. Description and designs of the flag and emblem of customs
bodies shall be approved by the Government of the Kyrgyz Republic.
Article 363. Places of Location of Customs Bodies
Places of
location of customs bodies shall be established by the Government of the Kyrgyz Republic based
on volume of passenger and goods flows, intensity of development of foreign
trade relations of certain regions, needs of transport organizations, exporters,
importers, other participants in international trade, as well as other factors.
Customs
bodies shall be located in premises belonging directly to customs bodies.
Customs posts and structural divisions of customhouses may be located at
premises belonging to owners of temporary storage warehouses, bonded warehouses
and duty free shops. Customs posts and structural divisions of customhouses and
customs posts may also be located at premises of participants in international
trade carrying out regular export and import transactions.
Article 364. Working Hours of Customs Bodies
1. Working hours of customs bodies
at points of entry through the State border of the Kyrgyz Republic, which by place of location
are the same as points of entry of adjacent states, should, if possible, coincide
with working hours of customs bodies of these adjacent states.
2. At a motivated
request of an interested person and with availability of necessary conditions,
certain customs procedures may be performed beyond working hours of the customs
body. |
