Chapter 5. Goods nomenclature of foreign trade
applied in the Kyrgyz Republic
Article 38. Goods Nomenclature of Foreign Trade
1. Goods nomenclature of foreign trade
is a classifier of goods, which includes goods headings, sub-headings and related
classification (digital) codes. Notes to the headings at any level of classification,
as well as the General Rules of Interpretation of the Goods Nomenclature of
Foreign Trade shall be inseparable part of the Goods Nomenclature of Foreign
Trade.
2. The Goods Nomenclature of Foreign
Trade shall apply for implementation of measures of customs-tariff and non-tariff
regulation of foreign trade and other types of foreign trade activity, maintaining
customs statistics of foreign trade of the Kyrgyz Republic.
3. The international basis of the
Goods Nomenclature of Foreign Trade applied in the Kyrgyz Republic shall
be the Harmonized Commodity Description and Coding System and the single Goods
Nomenclature of Foreign Trade of the Eurasian Economic Community.
Article 39. Maintaining the Goods Nomenclature of Foreign Trade
The authorized state body shall maintain
the Goods Nomenclature of Foreign Trade, which means:
1) ensuring tracking changes and supplements
in the international basis of the Goods Nomenclature of Foreign Trade, international
explanatory notes and decisions on interpretation of that basis;
2) ensuring preparation of proposals
on developing, changing and supplementing the Goods Nomenclature of Foreign
Trade with participation of interested state executive bodies;
3) support the actual conditon of
the standard copy of the Goods Nomenclature of Foreign Trade;
4) with participation of interested
state executive bodies, development of explanatory notes to the Goods Nomenclature
of Foreign Trade and providing their publication;
5) implementation of other functions
necessary for maintenance of the Goods Nomenclature of Foreign Trade.
Article 40. Classification of Goods
1. Goods, when declared, shall be
subject to classification by the customs bodies, i.e. a classified code (classified
codes) is assigned to goods according to the Goods Nomenclature of Foreign Trade.
2. At the request of the declarant
the customs bodies shall adopt a preliminary decision on classification of the
goods according to Chapter 57 of this Code. |
