Chapter 30. Conveyance of goods by certain
categories of foreign persons
Article 209. Scope of Application of this Chapter
1. Provisions of this Chapter shall
apply to goods conveyed through the customs border by diplomatic, consular and
other official representative offices of foreign states, international organizations,
personnel of these representative offices and organizations, certain categories
of foreign persons enjoying customs privileges in the customs territory of the
Kyrgyz Republic
in compliance with international agreements of the Kyrgyz
Republic.
2. Customs clearance of the goods
mentioned in item 1 of this Article, including declaring, shall be carried out
in accordance with a simplified procedure.
Article 210. Conveyance of Goods by Diplomatic Representative
Offices of Foreign States
Diplomatic representative offices
of foreign states in the territory of the Kyrgyz Republic may import into and
export from the Kyrgyz Republic the goods intended for official use by representative
offices with exemption from customs payments, except for customs fees for customs
clearance of goods payable at performance of customs procedures outside the
places intended for that and beyond working hours of the customs bodies.
Article 211. Conveyance of Goods by Head of the Diplomatic
Representative Office of a Foreign State and Members of the Diplomatic Staff
of the Representative Office
1. Head of the diplomatic representative
office of a foreign state and members of the diplomatic staff of the representative
office, as well as members of their families living with them may import into
the Kyrgyz Republic the goods intended for their personal use, including goods
for primary acquisition, and export from the Kyrgyz Republic the goods intended
for their personal use with exemption from customs payments, except for customs
fees for customs clearance of goods payable at performance of customs procedures
outside the places intended for that and beyond working hours of the customs
bodies.
2. Personal luggage of Head of the
diplomatic representative office of a foreign state, members of the diplomatic
staff of the representative office, as well as members of their families living
with them, shall be exempted from customs inspection, if there are no grounds
to assume that it contains goods not intended for personal use or goods, importation
or exportation of which is prohibited by legislation of the Kyrgyz Republic,
by international agreements of the Kyrgyz Republic. Such inspection should be
held only at presence of the persons mentioned in this Article or of their authorized
representatives.
Article 212. Conveyance of Goods by the Administrative and
Technical Staff of the Diplomatic Representative Office of a Foreign State
The administrative and technical
personnel of the diplomatic representative office of a foreign state and members
of their families living with them, if such employees and members of their families
do not permanently reside in the Kyrgyz Republic, may import into the Kyrgyz
Republic the goods intended for primary acquisition with exemption from customs
payments, except for customs fees for customs clearance of the goods payable
at performance of customs operations outside the places intended for that and
beyond working hours of the customs bodies.
Article 213. Extension of Customs Privileges Granted on the
Principles of Reciprocity
On the basis
of a special agreement with a foreign state, the customs privileges granted
by this Code may be extended to other persons, basing on the principle of reciprocity
with respect to each individual state.
Article 214. Conveyance of Goods by Consular Representative
Offices of Foreign State and Members of their Staff
The customs privileges stipulated
by this Code for diplomatic representative offices of foreign states or appropriate
staff of the diplomatic representative office shall be granted to consular representative
offices of foreign states, consular officials, including head of the consular
representative office, and consular officers, as well as members of their families.
Article 215. Conveyance of Diplomatic Pouch and Consular Diplomatic
and Consular Valise of Foreign States Through the Customs Border
1. Diplomatic pouch and consular
valise of foreign states, conveyed through the customs border, shall not be
subject to opening or arrest. Where serious reasons exist to believe that a
consular valise contains items not indicated in item 3 of this Article, the
customs body shall be entitled to demand that the consular valise be opened
by authorized persons of the represented foreign state in presence of a customs
officer. In the event of refusal to open the consular valise, it shall be returned
to the place of departure.
2. All pieces of luggage making a diplomatic pouch and consular valise shall
bear visible external signs indicating the character of theses pieces.
3.The diplomatic pouch may contain only diplomatic documents and goods, intended
for official use, while the consular valise, only official correspondence and
documents or goods intended exclusively for official use.
Article 216. Customs Privileges for Foreign Diplomatic and
Consular Couriers
Foreign diplomatic and consular
couriers may import into and export from the Kyrgyz Republic the goods intended
for their personal use, with exemption from customs inspection and customs payments
on the reciprocity basis, except for customs fees for customs clearance of goods
payable at performance of customs procedures outside the special places established
for that and beyond the working hours of customs bodies.
Article 217. Customs Privileges for Representatives and Members
of Delegations of Foreign States
The customs privileges
stipulated by this Code for members of the diplomatic staff of a representative
office of a foreign state shall be granted to representatives of foreign states,
members of parliamentary and governmental delegations, as well as on the basis
of reciprocity to members of delegations of foreign states arriving in the Kyrgyz
Republic for participation in interstate negotiations, international conferences
and meetings or on other official missions. Similar privileges shall be granted
to family members who accompany the mentioned persons.
Article 218. Customs Privileges for International Interstate
and Intergovernmental Organizations, Representative Offices of Foreign States
under Them, as well as Personnel of these Organizations and Representative Offices
Customs privileges for international
interstate and intergovernmental organizations, representative offices of foreign
states under them, as well as employees of these organizations and representative
offices and members of their families shall be established by international
agreements of the Kyrgyz Republic, ratified by President of the Kyrgyz Republic
or Jogorku Kenesh (Parliament) of the Kyrgyz Republic. |
