Chapter 23. Transit
Article 161. Content of the Customs Regime
Transit is a customs regime under
which foreign goods are conveyed throughout the customs territory of the Kyrgyz
Republic under customs control between the place of their arrival in the customs
territory of the Kyrgyz Republic and place of their departure from this territory
without payment of customs duties and taxes, and without application of non-tariff
regulatory measures thereto in compliance with legislation of the Kyrgyz Republic
on State regulation of foreign trade activity.
Article 162. Conditions for Placement of Goods under the Customs
Regime
Any goods, except for the goods
prohibited for transit in compliance with current legislation and international
agreements of the Kyrgyz Republic
may be placed under the customs regime of transit.
Article 163. Notification of Transit of Goods
Transit of goods shall be allowed
with notification of the customs body of the Kyrgyz Republic subject to conditions of Chapter
7 of this Code.
Article 164. Reloading and Other Operations with Goods
1. Reloading of goods carried in
compliance with the customs regime of transit from the means of transport, in
which the goods have been imported into the customs territory of the Kyrgyz
Republic to the means of transport, in which the goods will be exported outside
such territory, shall be allowed with notification of the customs body which
covers the region where such cargo operation is performed. Temporary warehousing
of transit goods in the customs territory of the Kyrgyz Republic shall be allowed if the requirements
and conditions of this Code are followed.
2. Operations, not mentioned in
Item 1 of this Article, with goods, which are under the customs regime of transit,
shall be allowed only in a case where fulfillment of such operations is caused
by real threat of destruction, loss, irrevocable loss or considerable damage
of goods and means of transport.
Article 165. Completion of the Customs Regime
1. The customs regime of transit
shall be completed by exportation of transit goods outside the customs territory
of the Kyrgyz Republic.
The carrier shall be obliged to present goods, customs declaration and other
documents on transit goods, used for purposes of transit, to the customs body
of destination. The customs body of destination shall be obliged to perform
necessary procedures to complete customs transit within the possibly shortest
period of time, while the carrier should actually export the goods and means
of transport outside the customs territory of the Kyrgyz Republic. The time limits for completion
of the customs regime of transit shall be established by the authorized state
body as agreed with the Ministry of Transport and Communication of the Kyrgyz Republic.
2. Transit of goods may also be
completed by their placement under other customs regimes if the requirements
and conditions of this Code are followed.
Article 166. Specifics of Application of the Customs Regime
of Transit
1. In cases when the place of arrival
of goods and means of transport in the customs territory of the Kyrgyz Republic and place of their exportation
from this territory coincide, the customs transit shall be allowed in a simplified
manner.
2. If goods are reloaded in the
place mentioned in Item 1 of this Article from the means of transport used at
arrival of goods to the means of transport used at their exportation, reloading
of the goods shall be allowed with notification of the customs body. |
