Chapter 10. Customs procedures at
exportation of goods outside the customs territory of the Kyrgyz
Republic
Article 78. The Leaving of Goods and Means of Transport from
the Customs Territory of the Kyrgyz Republic
1. The leaving of goods and means of transport from the customs
territory of the Kyrgyz Republic
shall be allowed upon authorization of the customs bodies to place the goods
under a specific customs regime, applied to exported goods in compliance with
this Code. Such authorization shall be issued in accordance with the procedure
and under the conditions established by this Code for release of goods (Article
299).
2. Specifics of performance of customs procedures at exportation
of goods outside the customs territory of the Kyrgyz Republic though pipelines
and power transmission lines shall be established by an Instruction of the Ministry
of Finance of the Kyrgyz Republic, on the basis of requirements and restrictions
set forth in this Code and taking into account the specifics of the goods exported
in the mentioned ways.
Article 79. Submission of Documents and Data
1. To receive permission of the
customs body for moving goods and means of transport out of the territory of
the Kyrgyz Republic, the carrier shall be obliged
to submit to the customs body a cargo declaration containing information on
the exported goods, as well as information on the means of transport.
Information, required by the customs
bodies, shall be limited to data necessary for identification of goods and means
of transport for customs purposes.
2. A specific list of data to be
submitted by the carrier at departure of goods and means of transport from the
customs territory of the Kyrgyz Republic shall
be specified in an Instruction of the Ministry of Finance of the Kyrgyz Republic, depending
on the type of transport.
3. Customs bodies shall accept documents
from the carrier stipulated by international agreements of the Kyrgyz
Republic in the area of transportation, as well as copies of customs
declarations in accordance with which the exported goods were placed under certain
customs regimes, as a cargo declaration.
4. If the data required by the customs
bodies are not contained in the documents provided by the carrier, the information
on goods and means of transport shall be provided in additional documents drawn
up the carrier or by other person at his instruction.
5. The carrier shall be obliged
to provide all the data on the goods carried by him in the cargo declaration
or to submit the information on the goods to the customs bodies in accordance
with procedure stipulated by Item 4 of this Article.
Article 80. Requirements to Goods at Their Exportation Outside
the Customs Territory of the Kyrgyz Republic
Goods should be actually exported
from the customs territory of the Kyrgyz Republic in the same quantity and condition
as they were at the moment of their placement under a certain customs regime,
except for the changes in the quantity and condition of goods due to natural
wear or decrease or natural specifics of goods under normal conditions of carriage,
transportation and storage.
Persons shall not be liable for
non-observation of the provisions of this Article in a case where the loss or
change of the condition of goods occurred due to an accident or force majeure,
and in cases stipulated by norms and standards effective in the Kyrgyz Republic, where
the quantity of goods changed due to errors in measuring. |
